The following terms & conditions from iApply will apply to all of the users who will purchase the job applying subscription from this portal.

If you purchase any of our subscription iApply E-Commerce Online Services will have the right to collect the total cost of the package in accordance with the package pricing displayed on the website. Subscription payment are due upfront for all of the packages, once payment processed successfully, then iApply E-Commerce Online Services will start the services.

IApply E-Commerce Online Services is not responsible for any fees charged to you by your bank in relation to our collection of payment.

You agree to pay iApply E-Commerce Online Services for any subscription purchased by any of the methods described on the iApply E-Commerce Online Services website. You hereby authorize the collection of such amounts by charging the debit/credit card provided as part of requesting the service either directly by iApply E-Commerce Online Services or indirectly via a third-party payment gateway or processor or by one of the payment methods described on the website. If you are directed to iApply E-Commerce Online Services’ third-party payment gateway or processor, you may be subject to terms and conditions governing the use of that third party’s service and that third party’s personal information collection practices. Please review such terms and conditions and privacy policy before using the services.

iApply E-Commerce Online Services does not promise or guarantee that the user will get an interview call or will get a job.

iApply E-Commerce Online Services will apply upto 4,000 Realtime jobs, if posted or available on the internet

We do not guarantee that the real time jobs will be available every time, as it depends from country to country and on Job Market.

For the Standard package, if the real time jobs are not available in the user selected countries, then iApply E-Commerce Online Services will do unlimited CV distribution to the HR Managers, Recruiters and Owners email ID’s.

For the Basic Package, iApply E-Commerce Online Services will only do Automated CV Distribution and will not do Real Time job Applying.

iApply E-Commerce Online Services is not responsible if the job posted on the Internet, Professional Job Sites, Professional Networking Sites, Companies Websites, Job Portals, or other Recruitment Sites is fake.

iApply E-Commerce Online Services will not re-write the user’s resume or cover letter.

Once the user has subscribed to any package, the user cannot downgrade the package before the expiration of their current package.

User can upgrade their package at any time. If the user places a request for the package upgrade before the expiration of the current package, then the user will have to pay the charges of the upgraded package and the previous package will get cancelled with the immediate effect. Upon this action, iApply E-Commerce Online Services will immediately stop the services related to the cancelled package and will start the services related to the upgraded package.

iApply E-Commerce Online Services will apply to all of the available jobs in all of companies in the countries selected by the user, iApply E-Commerce Online Services will not restrict or limit its Job applying services to any specific company or companies.

iApply E-Commerce Online Services do not guarantee that the user will land a job successfully or will get the desired salary.

All of the payments will be reoccurring and will be charged automatically at the time of subscription renewal date.

If the user do not wishes to renew/continue the subscription, then they can cancel the subscription at any time or before the renewal date.

For the first time users who registers with iApply E-Commerce Online Services and do not complete the my profile section and do not make the payment, then their user account will be deleted in 7 days from the date of registration and the user will have to fill in the details again on the iApply E-Commerce Online Services portal.

If the user payment fails at the first time while purchasing the subscription, then the user will get 7 days to update their payment method or make the payment successfully else the user account will be deleted, and the user will have to fill in the details again on the iApply E-Commerce Online Services portal.

If the payment fails at the time of auto renewal, then the user will get 7 days to update their payment method or make the payment successfully, else their account will be deactivated.

For the first time registration users, who will make the payment through offline channel (Bank Transfer/Exchange) they will get limited access to the user dashboard/portal features.

For the first time registration users, who will make the payment through offline channel (Bank Transfer/Exchange), they will get 5 days to upload the receipt of the successful payment transfer. If the receipt is not uploaded in 5 days, then the user account will be deactivated, and the user will have to fill in the details again on the iApply E-Commerce Online Services portal.

Once the offline payment users, uploads their payment receipt proof on the iApply E-Commerce Online Services portal, it will take 4 to 5 working days to validate/verify their payment from the backend and once the payment is Validated/Verified successfully, the user account will get activated.

For the current users who subscribe with iApply E-Commerce Online Services via offline payment channel, they will get 7 days to upload the new payment receipt for the subscription renewal. If the subscription renewal payment is not processed in 7 days prior to the subscription expiration, then the user account will get deactivated after the subscription expiration date.

If the user wishes to cancel their subscription, they can do it any time before the subscription renewal date. If the subscription is not cancelled before the renewal date, then subscription renewal payment will be charged to the user automatically, as all of our subscription are reoccurring auto renewal.

At the time of subscription renewal, if the payment is not processed successfully or if it gets failed due to any reason or if the offline payment channel user has not uploaded their payment receipt, then iApply E-Commerce Online Services will stop the services provided to the user, immediately from the date of payment failed or subscription expiration.

If you cancel your subscription before the subscription expiration date, you will still get the services till the subscription end date.

You should use your own credit/debit card details to make online payments when you purchase any of our subscription.

DMCA

The Digital Millennium Copyright Act of 1998 (the “DMCA“) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted by iApply E-Commerce Online Services infringe upon your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. The notice must include the following information as required by 17 USC. § 512(c)(3)(A): (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed (or if multiple copyrighted works located on the site are covered by a single notification, a representative list of such works); (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Indeed to locate the material on the site; (d) the name, address, telephone number, and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Suspicious & Unauthorized Activity

You understand and agree that you are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of our website and/or services. In connection with your use of our website and services, you agree that you will not violate any local, state, provincial, national, or other law or regulation, or any order of a court, including, without limitation, zoning restrictions, and tax regulations; hack, crack, phish, SQL inject, or otherwise interfere with the integrity of the computer systems of our website, Service, or Clients; defame anyone; defraud, mislead, or otherwise act dishonestly; copy, store, or otherwise access any information contained on the website or within any content appearing therein, for purposes not expressly permitted by these Terms; use the website or services for any commercial or other purposes that are not expressly permitted by these Terms; use the website or services to transmit, distribute, post or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card, or account numbers; stalk or harass any other client of the website or services or collect or store any personally identifiable information about any other client; impersonate any person or entity, or falsify, or otherwise misrepresent yourself or your affiliation with any person or entity; run any bots or other software to aggregate or browse our content; post fake information, whether it is about a job, company, or your own credentials as a job applicant; infringe on anyone’s intellectual property rights; otherwise act in a manner which, at FMP’s sole discretion, is objectionable.

 

Liability Limitation

iApply E-Commerce Online Services is a service provider who helps people/users/customers in applying for jobs on their behalf. However, iApply E-Commerce Online Services is not involved in the actual hiring process and has no control over hiring decisions related to any Job applied by iApply E-Commerce Online Services.

Further, iApply E-Commerce Online Services has no control over the content submitted by its users/customers/clients including, but not limited to, resumes, and personal information.

iApply E-Commerce Online Services has no control over the quality, safety, or legality of jobs applied to or resumes submitted on behalf of its users/customers/clients and makes no representations about any jobs, resumes, or content. You acknowledge and agree that you are solely responsible for the accuracy, form, and substance of any of your generated content. You further acknowledge that iApply E-Commerce Online Services shall not be responsible for your career decisions

iApply E-Commerce Online Services shall not be liable to you for any damages resulting from any information or advice given to you by any employees, agents, officers, owners, directors shareholders of affiliates of iApply E-Commerce Online Services.

iApply E-Commerce Online Services shall not be liable to you for any damages resulting from any information or advice or threat given to you by the Job poster, employer or interviewer, where iApply E-Commerce Online Services applied a job for you.

iApply E-Commerce Online Services shall not be liable for any damages resulting from your use of any materials generated by iApply E-Commerce Online Services.

In no event shall iApply E-Commerce Online Services be liable to you for any indirect, extraordinary, exemplary, punitive, special, incidental, or consequential, damages (including loss of data, revenue, profits, use or other economic advantage), however arising, even if iApply E-Commerce Online Services knows there is a possibility of such damage.

iApply E-Commerce Online Services’s maximum total, aggregated liability arising out of or in connection with the site and any materials of services provided therein, regardless of the cause of action (Whether in contract, tort, breach of warranty of otherwise), will in no event exceed the total amount you have paid to iApply E-Commerce Online Services related to the subscription package you subscribed for.

Indemnity

You agree to indemnify and hold harmless iApply E-Commerce Online Services and its principals, shareholder, agents, officers, directors, consultants, subsidiaries, licensors, and employees from any and all claims, damages, obligations, payments, deficiencies, fines, judgments, settlements, losses, liabilities, costs or debt, and expenses (including, but not limited to, attorney’s fees) arising from or relating to:

Any third-party claim, suit, action or proceeding arising out of the breach of iApply E-Commerce Online Services’s representations and warranties contained herein;

Your use and access to any of iApply E-Commerce Online Service’s services, including any data or content transmitted or received by you;

Your violation of any term of this Agreement; or

Your violation of any third-party right, including without any limitation, any rights of privacy or intellectual property rights.

 

Changes in Terms & conditions

iApply E-Commerce Online Services have the rights and may make any changes to the content of this agreement and features of the iApply E-Commerce Online Services site, portal and the services at any time, with or without notice to you.

iApply E-Commerce Online Services can change or update this Agreement at any time by posting updated Terms & Conditions on iApply E-Commerce Online Services’s website. If we make a material modification to this Agreement or the Privacy Policy, we may or may not send a notification to your registered email address. We recommend that you always check our Terms & conditions page and also check the last modified date.

If you do not agree to any of the updated terms, you must stop using iApply E-Commerce Online Services’s website, portal and services immediately and no refund will be given.

 

Refund Policy:

All of the payments made regardless to the payment mode/channel are non-refundable

Once the subscription gets activated after the payment, under any circumstances the subscription amount will not be refunded.

The user can cancel the subscription at anytime before the subscription renewal date.

All of the subscriptions are on reoccurring auto renewal, once the auto renewal is successfully done and the user decides to cancel it or ask for refund, it will not be refunded.

If the user cancels their subscription before the subscription expiration date, they will still get the services till the subscription end date. The user will not be charged for the upcoming renewal amount, also the current subscription amount will not be refunded.

General Terms

If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. This Agreement is the entire agreement between you and iApply E-Commerce Online Services and supersedes all prior or contemporaneous negotiations, discussions or agreements between you and iApply E-Commerce Online Services about the Site. The proprietary rights, disclaimer of warranties, representations made by you, indemnities, limitations of liability, and general provisions shall survive any termination of this Agreement.
